Welcome to GrowToday.biz ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website https://growtoday.biz and all services we provide, including website design, development, digital marketing, SEO, advertising management, and related consulting services (collectively, the "Services").

By accessing our website, requesting a quote, signing a proposal, Sending or authorizing payment, or engaging our Services in any way, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

• 1. Services

  We provide website design, development, digital marketing, and related services to small and local businesses. The specific scope, deliverables, timeline, and fees for your project will be outlined in a separate written or verbal proposal, quote, or service agreement ("Project Agreement"), which becomes part of these Terms once accepted by you.

• 2. Project Agreements & Payment

  • All Services are provided only after acceptance of a written Project Agreement or payment

  • You agree to pay all fees as outlined in the Project Agreement.

  • Remaining balance is due upon completion of agreed deliverables, milestone completion, or according to the payment schedule in the Project Agreement (If agreed upon by both parties).

  • Late payments may incur interest at 1.5% per month (or the maximum allowed by law) and may result in suspension or termination of Services.

  • All fees are non-refundable except as explicitly stated in the Project Agreement.

• 3. Client Responsibilities

  You agree to:

  • Provide accurate, complete, and timely information, content, images, logos, access credentials, and feedback

  • Obtain all necessary rights, licenses, and permissions for any materials you provide to us

  • Approve or request changes in a timely manner

  • Make payments on time

  Delays caused by your failure to provide required items or approvals may delay the project timeline and may result in additional charges.

• 4. Intellectual Property & Rights of Use

  • Upon full payment of all fees due under the Project Agreement, we grant you a non-exclusive, perpetual license to use the final deliverables created specifically for your project.

  • We retain ownership of all pre-existing materials, templates, code libraries, design elements, processes, and general know-how ("Our IP").

  • We retain the right to use your project name, logo (if provided), general description of work performed, and non-confidential results/achievements (e.g. traffic growth, lead increases, design improvements) in our marketing materials, website portfolio, case studies, social media, and advertising — unless you notify us in writing that you do not wish us to do so.

• 5. Revisions & Changes

  • The number of revisions for websites included (if any) will be specified in the Project Agreement. We offer maintenance with our $97/month package, meaning if you want a photo added we can do that. If you are requesting changes to the website everyday this is available on a higher plan.

  • Additional revisions, scope changes, or requests outside the original scope may incur extra fees at our then-current hourly rate or as mutually agreed.

• 6. Warranties & Disclaimers

  We warrant that Services will be performed in a professional manner consistent with industry standards.
  EXCEPT AS EXPRESSLY STATED, ALL SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  We do not guarantee specific search engine rankings, traffic levels, sales increases, or any particular business results from marketing efforts.

• 7. Limitation of Liability

  To the maximum extent permitted by law, our total liability to you (whether in contract, tort, or otherwise) shall not exceed the total fees actually paid by you under the relevant Project Agreement in the 12 months preceding the claim.

  We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, business interruption, or loss of business opportunity.

• 8. Termination

  Either party may terminate the Services for material breach if the breaching party fails to cure within 10 business days of written notice.
  Upon termination, you remain responsible for all fees for Services performed up to the termination date.

• 9. Third-Party Services

  We may use third-party tools, platforms, plugins, hosting providers, ad networks, web security etc. Your use of those services is governed by their respective terms. We are not responsible for third-party actions, outages, or changes in policies.

• 10. Governing Law

  These Terms shall be governed by the laws of the Province of Alberta, without regard to conflict of law principles.

• 11. Changes to Terms

  We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
